Austin assists public agencies and private clients in a variety of matters including surface and groundwater rights, the area of origin doctrine, and endangered species issues. He also provides clients with valuable insight concerning the Sustainable Groundwater Management Act, The Brown Act, The Public Records Act, the California Environmental Quality Act (CEQA), and matters before the State Water Resources Control Board.

Experience

  • Provides water rights advice and legal assistance to public entities and private interests.
  • Counsels public agencies regarding compliance with transparency laws such as the Brown Act, the Public Records Act, and Proposition 218.
  • Advised on the formation of Groundwater Sustainability Agencies in compliance with the Sustainable Groundwater Management Act.
  • Assisted with discovery review in complex groundwater rights litigation in Southern California for a public agency client.
  • Petitioned for and obtained a temporary urgency permit to appropriate water for storage so that landowner could replenish his reservoir.
  • Provided guidance on the current state of the Area of Origins doctrine.
  • Drafted a restrictive covenant and easement for the construction and operation of flood control facilities.
  • Prepared testimony, exhibits, and descriptions of the appropriative and riparian water rights of dozens of clients for the California WaterFix change petition hearings before the State Water Board.  
  • Produced a comprehensive primer on the permitting and licensing standards for the distribution of drinking water from a private spring. 
  • Counseled a public agency client on strategy relating to an upstream diverter’s petition for assignment of high-priority state-filed applications; drafted request to the State Water Board for Release from priority in favor of client’s license.
