Indian Wells Valley Groundwater Authority Petitions California Supreme Court for Review of Trial Phasing Order in Comprehensive Groundwater Adjudication

On November 25, 2024, the Indian Wells Valley Groundwater Authority (Authority) filed a petition for review with the California Supreme Court (Petition), challenging an August 5, 2024, trial phasing order in the comprehensive groundwater adjudication of the Indian Wells Valley Groundwater Basin. (Indian Wells Valley Groundwater Authority v. Superior Court of Orange County, California Supreme Court, Nov. 25, 2024, Case No. S288048.) In the wake of a summary denial of the Authority’s petition for writ of mandate on November 14, 2024 (Fourth District Court of Appeal, Case No. G064757), the Petition seeks clarification from the Supreme Court on the interplay between the Sustainable Groundwater Management Act (SGMA) and the so-called Streamlined Adjudication Statutes, which govern the legal process for groundwater adjudications under SGMA.
