With a sharp eye for problem solving and a keen understanding of the law and client needs, Amanda Pearson is a strong and effective advocate for both private and public agency clients dealing with water law and environmental issues.

Amanda represents private and public agency clients in a broad range of matters involving water and environmental compliance, including water supplies and water rights, California Environmental Quality Act compliance and litigation, environmental permitting, and flood protection. She appreciates the challenges of managing California’s scarce water resources, and knows that effective solutions must be tailored to a client’s needs. Known as a strong advocate, she vigorously defends her clients’ rights, both in and out of court.

Amanda understands the regulatory hurdles clients face – and how to navigate them. In handling permitting and compliance matters, she endeavors to streamline the process for her clients, making use of all available tools. She has experience dealing with the State Water Resources Control Board, the Department of Water Resources, the Department of Fish and Wildlife, the Bureau of Land Management, and the Bureau of Reclamation. Amanda also advises public agency clients regarding conflict of interest laws, the Brown Act, and the Public Records Act.

Based on her depth of experience, Amanda is a frequent presenter on CEQA, flood liability, and public agency ethics, and an active volunteer for the Sacramento County Public Law Library’s “Lawyers in the Library” program.

Experience

  • Advocated for private landowners’ right to make repairs to water pipeline crossing other properties and fended off litigation regarding same.
  • Assisted with resolution of a dispute between multiple public agencies regarding water quality mitigation and drafted agreement to settle the dispute.
  • Drafted brief in appeal of case regarding rights of one party to convey water through the facilities of another party under California law.
  • Assisted in securing the dismissal of reverse validation and mandate causes of action in multi-party suit challenging amendments to the State Water Project contracts.
  • Drafted arguments that defeated motion for preliminary injunction in a CEQA case challenging an exemption determination for a prison conversion project.
  • Drafted and reviewed numerous CEQA compliance documents (including Notices of Exemption, Mitigated Negative Declarations, and Environmental Impact Reports) for public agency water supply and flood control projects.
  • Drafted and filed water rights change petitions; assisted with shepherding water rights applications through the State Water Resources Control Board Process
  • Handled CEQA, Clean Water Act, and Streambed Alteration compliance for local public agency pipeline replacement project.
  • Responded to State Water Resources Control Board enforcement letter and assisted in securing an amicable resolution for the landowner.
  • Drafted amicus letter in support of petition for California Supreme Court review of a CEQA case; review was granted.
