California’s Prop 65: Acrylamide Update

The Office of Environmental Health Hazard Assessment added acrylamide to the Proposition 65 list in 1990 and ever since, it’s mention on the list has been highly controversial. Recently in October 2019, California’s Chamber of Commerce initiated litigation in federal court alleging that acrylamide’s Prop. 65 warning requirements violate the first amendment because the State does not “know” that consuming food containing acrylamide causes cancer. Even more recently in 2021, the controversial inclusion of acrylamide on the Prop 65 list is going to court once again.
