California Governor Newsom Utilizes New Infrastructure Streamlining Law to Certify Judicial Streamlining of the Sites Reservoir Project

On November 6, 2023, Governor Newsom, acting under his authority under California’s new Infrastructure Streamlining Law, certified judicial streamlining of the Sites Reservoir Project (Project). The Governor’s action requires courts to decide challenges to the Project under the California Environmental Quality Act (CEQA) within 270 days (to the extent feasible) from the date the administrative record is filed. This action should accelerate the timeline for completing the project by avoiding costly litigation delays associated with challenges to the Project under CEQA.
