Protecting Local Ratemaking Authority
November 29, 2023
ACWA 2023 Fall Conference & Exhibition
Recently, the “Taxpayer Protection and Government Accountability Act,” qualified for the November 2024 General Election and if passed, would severely limit local ratemaking ability. Some are calling this statewide initiative the most consequential proposal to limit the ability of the state and local governments to enact, modify, or expand taxes, assessments, fees, and property-related charges since the passage of Proposition 218 in 1996. If enacted, public agencies could face a drastic rise in litigation that could severely restrict their ability to meet essential services and infrastructure needs.
Join Downey Brand partner Rebecca Smith at the annual AQWA Fall Conference on Wednesday, November 29, 2023 at 2:30 PM to discuss the proposed initiative, the Legislature’s attempt to counter this proposal, and the potential impacts on local governments in California. ACWA Deputy Executive Director Cindy Tuck will serve as moderator, and co-panelists will include Best Best & Krieger partner Lutfi Kharuf and Olson Remcho partner Richard Rios.
You’ll learn about:
- The issue posed by the “Taxpayer Protection and Government Accountability Act”
- The potential impact of the initiative on local ratemaking
- The issue from a litigation and political perspective
Hear four quick presentations from the panel, then join an engaging Q&A where you can ask questions about the past, present, or future of this proposed initiative.
