Flowage and Habitat Conservation – Can they Coexist?

Downey Brand water law partner Andrea Clark will be moderating the legal panel, “ Flowage and Habitat Conservation – Can they Coexist?,” on Thursday, September 7, 2023, during the Floodplain Management Association’s Annual Conference in Los Angeles (Sept 5-8,2023).

Levee setbacks play an important role in adding flexibility to the flood protection system, which is necessary to address future climate and flow uncertainties. However, over the past decade, it has been hard to reach consensus on the legal framework for using setback areas conjunctively for flow and habitat conservation. The legal panel will unpack the issues and give an update on the status of multi-purpose projects addressing this issue.
