Enforcing Arbitration Agreements in Bankruptcy Proceedings.” There is inherent tension between the centralized approach to claim reconciliation ensconced in the Bankruptcy Code and the decentralized approach underlying the Federal Arbitration Act. How do bankruptcy courts decide whether and when to lift the automatic stay in order to permit an arbitrator, rather than the bankruptcy judge, to liquidate claims against the estate? Our panelists will address these and other questions raised by the intersections between the Bankruptcy Code and other federal laws.
