Labor and Employment

Lead trial counsel representing management in employment litigation including claims of wrongful discharge, violations of public policy and various discrimination claims based upon sex, age, race, disability, religion, pregnancy and marital status.

Wage and hour litigation in state and federal courts on multiple issues including misclassification issues, unpaid overtime, meal and rest periods and penalties.

ERISA litigation defending plans and plan fiduciaries on claims for benefits by plan beneficiaries.

Lead counsel in defense of businesses against tax assessments by EDD based upon the agency's assertion of employment status for the independent contractors used by my clients.

Unfair competition claims and misappropriation of trade secrets.

Lead counsel in the case of Mary M. v. Capital City Foods, Inc., where writ was obtained overturning the denial of summary judgment motion based upon the failure of plaintiff to establish a sufficient nexus between the sexual assault by a co-employee and employment to trigger vicarious liability of the employer.

Experienced mediator in multiple employment and business disputes.
