Wiemond Wu focuses on delivering clients with clever, cost-effective, and concrete solutions in a wide range of litigation disputes.

As a litigator, Wiemond represents clients in disputes arising from real property, land use, business entities, employment, construction defect, and trust and estates across California state and federal courts. Wiemond also represents clients in the probate process and counsels non-profit organizations. His breadth of experience places him in an advantageous position to effectively analyze different claims and weed out meritless allegations in any legal context. Recently, Wiemond’s assistance in a matter resulted in a complete reversal at the California Supreme Court in our client’s favor.

Before practice, Wiemond was recognized as his graduating class’s Top Oral Advocate and for writing a Best Appellate Brief in the school-wide moot court competition. Wiemond also served as a judicial extern to the Hon. Kimberly J. Mueller at the U.S. District Court for the Eastern District of California.

General Litigation Matters

  • Represent custom pharmaceutical manufacturer against drug manufacturer in ongoing litigation for breach of contract, unjust enrichment, and misrepresentation claims.
  • Represent large institutional client in various litigation matters, including claims for fraud, misrepresentation, and constructive trust issues.
  • Represent vehicle dealership in litigation for conversion and theft of personal property. Case is pending.
  • Represent out-of-state pharmaceutical manufacturers in California website accessibility lawsuits, including jurisdictional challenges. Case is pending.
  • Assisted in discovery resolution in litigation pending simultaneously in various venues across the United States, including California, Texas, and Delaware.
  • Assisted in multi-party constructive defect litigation, including preparation of motions in limine to exclude evidence at trial. Case favorably settled after mediation, resulting in multi-million settlement.
  • Assisted in litigation against various insurance companies regarding fire damage.
  • Assisted in appeal at the California Supreme Court regarding jurisdiction and governmental immunities. Resulted in complete reversal in favor of client.

Probate / Trust & Estate Litigation

  • Represent court-appointed administrator in ongoing eminent domain action against estate and separate breach of contract action seeking multi-million dollars in damages against the estate. Cases are pending.
  • Represent various clients in elder abuse and undue influence claims by overseeing all phases of discovery and assisting with dispute resolution.
  • Represent individuals in probate court, including petitions for probate, guardianships, and conservatorships.
  • Represent trustees and beneficiaries in trust litigation matters, including petitions to modify and amend and petitions to determine title.
  • Assist in ongoing litigation between co-trustees/beneficiaries over trust assets exceeding several million dollars.
  • Successfully represented a local non-profit organization in petition to release restrictions on institutional funds under Probate Code.

Real Estate / Land Use Litigation

  • Represent a fully developed recreational ranch in Northern California (exceeding several thousand acres of land) in lawsuits against landowners regarding unpaid assessments, dues, and title issues. Oversee all pending litigation from complaint to resolution.
  • Represent a commercial tenant in ongoing litigation against former landlord for breach of commercial lease agreement.
  • Advise and assist commercial landlords and tenants in resolution of ongoing lease disputes, including disputes arising from the COVID-19 pandemic
  • Assist in pending appeal regarding inverse condemnation and water rights issues on behalf of local public agency.
  • Represented individuals in lawsuit against local public agency for inverse condemnation and real property claims. Case settled favorably for client at mediation.

Employment Matters

  • Advise and counsel non-profit statewide trade association representing the food industry relating to ongoing litigation and privacy issues.
  • Represented private employer against claims included fraud and various wage and hour claims. Case settled favorably for client.

On his free time, Wiemond will most likely be cooking, gardening, or exploring the greater Sacramento region with his wife and their rescue pup, Addie. Originally from San Francisco, Wiemond is a proud first-generation Chinese-American. He is the first in his family to graduate college and law school.
