Her presentation will focus on the Trump Administration’s new rules regarding what constitutes “waters of the United States.” See below for Mapistry’s description of the session.

In January 2020, the Trump Administration issued new rules regarding what constitutes “waters of the United States” in an attempt to provide brighter line rules and to constrict some aspects of the previous 2015 WOTUS rule issued by the Obama Administration. We will discuss the scope of what is now a WOTUS, what features are considered differently from past rules, summarize the current status of litigation on both the 2015 and 2020 WOTUS rule as well as the outcome of the County of Maui case currently being considered by the U.S. Supreme Court related to discharges to groundwater hydrologically connected to surface waters and whether such discharges require a Clean Water Act NPDES permit, and how some States are reacting to the 2020 WOTUS rule by adopting state programs to retain some of the more expansive elements of the 2015 WOTUS rule.
