Nicole Martin helps clients successfully resolve their environmental and land use challenges.

Nicole has experience with numerous environmental and land use laws, including the California Environmental Quality Act (CEQA), the California Land Reuse and Revitalization Act of 2004 (CLRRA), the Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA), California’s Hazardous Waste Control Law, and the Clean Water Act. Nicole represents clients in connection with CEQA compliance and litigation matters as well as regulatory enforcement actions and private litigation under other federal, state and local environmental and land use laws. She also advises clients in connection with the purchase and redevelopment of contaminated properties. 

Prior to law school, Nicole worked for several years as an environmental consultant preparing CEQA compliance documents and as a project manager with a non-profit organization where she negotiated and secured countywide permits and approvals from federal, state, and local regulatory agencies for voluntary restoration projects on private lands. The work provided a strong technical foundation and an appreciation for collaborative approaches, where feasible, that Nicole draws upon in pursuing optimal results for her clients. 

Experience

  • Completed numerous environmental due diligence reviews for developer clients to inform their acquisition and redevelopment of contaminated properties.
  • Drafted and negotiated various agreements, including land use covenants and operation and maintenance agreements, between developer clients and regulatory agencies in connection with remediation and redevelopment of contaminated sites.
  • Collaborated with environmental consultants to inform environmental investigation and remediation activities in connection with redevelopment activities.
  • Drafted and negotiated easement agreements between developer client and municipality in connection with mixed-use development project.
  • Represented commercial property developer throughout project approval and CEQA process for 18-acre shopping center, and successfully defended project in trial court against suit challenging project’s environmental impact report and its consistency with the City of Modesto general plan.
  • Represented manufacturer and major retailer clients in litigation under California’s Safe Drinking Water and Toxic Enforcement Act of 1986 (Prop 65).
