History and Updates of the Clean Water Act Permitting Requirements held to apply to the Use of Pesticides in Water

In a previous Downey Brand Water Quality Alert, April 2001 , we informed people of the impacts of the Talent case on pesticide permitting.

On July 19, 2001, the SWRCB adopted a general permit to cover these pesticide applications. To obtain coverage under this permit, pesticide applicators must fill out Form A attached to the permit and return it to the State Water Resources Control Board and their Regional Board immediately.

EPA and the SWRCB then issued guidance documents related to this issue and is currently reauthorizing permit requirements.

Since then, many other cases have been decided and the need for permitting of the agricultural discharges under the Clean Water Act still remains in flux.
