Water Law Representative Experience
Our water law experience includes:
- Negotiating water transfer from a Sacramento Valley mutual water company to a California State Water Project customer.
- Negotiating a purchase by a Bay Area municipal water supplier of a State Water Project entitlement from an agricultural water district in the San Joaquin Valley.
- Representing a California county in a CEQA "takings" and "due process" action challenging the county's adoption of an ordinance requiring permits to drill groundwater wells.
- Representing real estate developers in litigation to determine whether lands within a watershed that do not vertically overly a groundwater basin have overlying rights to that groundwater.
- Negotiating long and short-term water supply, repayment, and operations and maintenance contracts between the Bureau of Reclamation and Nevada and California public and private water entities.
- Negotiating with federal and state agencies on behalf of federal reclamation water users in connection with water quality issues associated with federal reclamation projects.
- Serving as general counsel to various public agencies on a variety of public agency legal issues including open meeting requirements, agency organization, election procedures, conflict of interest rules, and state mandated cost claims.
- Providing regulatory and wastewater permitting advice to numerous publicly owned wastewater treatment plans throughout the state.
- Representing publicly owned treatment works revising ordinances regulating industrial dischargers and establishing enforcement program for pre-treatment. Advising publicly owned treatment works on enforcement of ordinances including claims against dischargers.
