Environmental Law Representative Experience

Examples of our recent environmental law experience include:

  • Representing an Environmental Response Trust in responding to an emergency response Unilateral Administrative Order issued by EPA Region 9. The order involved an abandoned waste oil recycling facility located in California's central valley.
  • Representing a company in administrative proceedings and negotiations with various regulatory agencies for a $30 million cleanup of a federal Superfund site in Northern California.
  • Representing clients in cost recovery actions involving soil and groundwater contamination.
  • Representing numerous past and present property owners and service station operators with underground storage tank sites. Our experience with UST sites ranges from negotiating access and cost-sharing agreements with other responsible parties to litigation. We are also experienced with the UST Cleanup Fund application process and appeals to the State Water Resources Control Board.
  • Representing lenders, borrowers, landowners, purchasers and lessees of real property in connection with due diligence efforts and the negotiation of special environmental provisions in loan and real estate transaction documents.
  • Representing companies and individuals in civil enforcement actions filed by the California Attorney General and federal criminal prosecutions by the U.S. Attorney's Office.
  • Representing clients in site investigations, hazardous substances regulation, and cleanup.
  • Representing lenders, developers and corporations on recognizing, evaluating, and avoiding environmental liabilities associated with real property and business transactions.
  • Representing clients on the full range of issues with regard to permitting and enforcement under the Clean Water Act and the Porter-Cologne Water Quality Act.
  • Providing regulatory and wastewater permitting advice to numerous publicly owned wastewater treatment plants throughout the state, including the negotiation of permit requirements and appearing before the relevant Regional Water Quality Control Boards.
