Plastic Bag Ban


In a recent high profile decision, Downey Brand environmental attorneys successfully convinced a judge to ‘ban’ the plastic bag ban in Oakland. Arguing that the City of Oakland’s proposed alternatives to plastic shopping bags are as harmful as plastic, if not more, Michael Mills, convinced Alameda County Superior Court Judge Frank Roesch to grant the injunction against the ordinance.


The lawsuit was filed against the City of Oakland by the Coalition to Support Plastic Bag Recycling, a group consisting of plastic packaging manufacturers, plastic bag manufacturers and plastic recyclers. Mills, representing the group, was quoted in various media sources reporting on the Oakland ordinance, stating that the City of Oakland did not perform the full environmental review as required under state law.
