Representation of public entities and private property owners in breach of contract, land use, eminent domain, inverse condemnation, environmental and water rights litigation.

The use of expert witnesses in the areas of business value (including goodwill), real estate value, agriculture operations (orchards, vineyards, row crops, alfalfa and pasture property), agriculture packing and shipping operations, water quality and geotechnical engineering.

Max's experience includes:

Currently counsel for Three Rivers Levee Improvement Authority handling real estate acquisition (ROW), eminent domain and inverse condemnation (Yuba County, California). Completing acquisition of land for the Feather River segment (nine matters set for trial in 2010). Coordinating acquisition of parcels for construction, operation and maintenance of the Yuba River segment in 2010 and 2011.

Counsel for public utility district in action involving issues of water rights in the Santa Margarita River, the relationship of surface and ground water in the Santa Margarita river watershed and all of its sub basins, the impact of urban runoff on both groundwater and the river system, water quality constituents and reclamation wastewater treatment by the defendant water districts and Camp Pendleton (CPEN); Counsel to irrigation district in eminent domain actions as part of major electrical line expansion; Counsel to San Joaquin County reclamation districts defending against property owner claims following levee failures; Counsel to multiple property owners in actions arising from City of Stockton Redevelopment Agency's taking of downtown properties.
