Spencer Christensen’s practice focuses on litigation with experience in a broad array of matters. Spencer routinely represents individuals and corporate clients in litigation involving breach of contract, fraud, bankruptcy and insolvency related issues. Spencer has further experience representing clients in employment litigation, false advertising, and unfair competition. Spencer’s representation has extended from large corporations and banks, to small and mid-size companies and individuals. ExperienceDefended client in class-action suit involving claims of unfair competition, false advertising, fraud and negligent misrepresentation. Drafted motions, including a demurrer, propounded and responded to extensive discovery and managed complex document production issues. Action settled on favorable terms for the client after mediation. Represented client in a contractual dispute with a partner and co-owner of a restaurant involving claims for breach of contract, dissolution of an L.L.C., and appointment of a receiver. Successfully achieved the appointment of a receiver until the action was subsequently stayed by the co-owners bankruptcy filing. Successfully represented the client in purchasing the co-owner’s interest in the restaurant from the bankruptcy estate providing the client sole ownership and operational control. Represented a bank in multiple fraud actions in bankruptcy court against borrowers for intentionally misstating or misrepresenting their income when applying for loans. This representation resulted in multiple favorable judgments for the bank upon which the bank either received lump-sum or stipulated monthly payments, or required judgment enforcement through the federal and stated enforcement procedures. Currently representing the Official Committee of Unsecured Creditors in the SK Foods Chapter 11 proceeding in the Eastern District of the United States Bankruptcy Court. Successfully represented a bank client in negotiations to modify a multi-million dollar loan. Successfully avoided the cost and attendant delay of foreclosure litigation by entering into a beneficial modification and forbearance agreement which provided the client an immediate and substantial principal pay-down and on-going payments for the term of the loan.
