Bio

Former chair of Downey Brand’s Energy, Land Use, and Minerals group, Wendy Bogdan has extensive expertise in land use/environmental compliance and litigation and has represented private and public entities on residential, commercial, industrial, and infrastructure projects, both in compliance and litigation matters. Wendy adapts her approach to best serve the needs of clients, whether they are permitting a small, commercial project, or a multi-billion dollar state-wide infrastructure project. Accordingly, Wendy has helped numerous entities permit, and where necessary litigate, approvals for residential developments; light-industrial businesses, such as car washes; and heavier-industrial businesses, such as mines or ports. In addition, she also acts as lead special counsel for the State of California’s expansion of its correctional system.


In the area of California Environmental Quality Act (CEQA) compliance, she has represented both lead agencies and private project proponents to develop financing and project development strategies that maximize the client’s flexibility and financial leverage while ensuring adequate CEQA compliance. Similarly, in the area of natural resources compliance, Ms. Bogdan works with clients to develop projects that will not only comply with applicable laws (such as AB 32, the federal and state Endangered Species Act, the federal Clean Water Act, and California’s Porter-Cologne Water Quality Control Act), but, wherever possible, will also enhance the project’s economic value for the client.
