With a particular focus on litigation and regulatory compliance defense, Olivia Wright assists clients with a broad range of environmental law issues.

Olivia represents public sector and industry clients in defending both regulatory enforcement and third-party citizen suits under the Clean Water Act, and in litigation involving contaminated sites, including cost recovery and allocation under the Comprehensive Environmental Response, Compensation, and Liability Act and actions for damages under state law.  In addition, Olivia has substantial experience in real estate and business litigation.

Experience

Environmental Litigation Experience

  • Advised and represented property owners in cost recovery litigation involving dry cleaning solvent contamination in soil and groundwater at numerous sites.
  • Advised national car rental company in claims brought by property owner arising from alleged petroleum discharge.
  • Advised and represented public sewer district against regulatory enforcement action under the Clean Water Act involving alleged sanitary sewer overflow.
  • Advised and represented public sewer district against third-party citizen enforcement action under the Clean Water Act and Porter-Cologne Water Quality Control Act involving alleged sanitary sewer overflows and other wastewater discharges.
  • Advised and represented municipality in defense of third-party citizen enforcement action under the Clean Water Act involving alleged violations of NPDES permit related to municipal stormwater runoff.
  • Advised and represented concrete manufacturing company against third-party citizen enforcement action under the Clean Water Act involving alleged discharges of industrial stormwater runoff in violation of the Clean Water Act and applicable NPDES permit.
  • Prepared several briefs on behalf of numerous amici curiae representing cities and counties in support of petitions for appellate and U.S. Supreme Court review in a third-party citizen enforcement action against a municipality and flood control district involving alleged discharges of municipal stormwater runoff in violation of the Clean Water Act and NPDES permit.
  • Represented public sewer district in litigation to compel disclosure of regulatory agency documents under the California Public Records Act.  Successfully obtained the issuance of a writ of mandate and an award of attorneys’ fees and costs to the client.
  • Advised and represented private agricultural landowner against enforcement action under the Clean Water Act involving alleged destruction of wetlands.
  • Represented private company in defense of qui tam relator action filed under the California False Claims Act involving the alleged submission of improper claims to the Underground Storage Tank Cleanup Fund.

Representative Business Litigation Experience

  • Lead member of litigation team in successfully defending large food processer against claims alleging violations of California’s Unfair Competition Law, violations of several Food and Agricultural Code provisions relating to grower cooperative bargaining associations, and conversion. Successfully obtaining a favorable final arbitration award on one class claim including an award of attorneys’ fees and expenses, and an order decertifying the remaining class claim.
  • Lead member of litigation team in complex arbitration of a partnership dispute seeking rescission of the partnership agreement; the arbitration resulted in a favorable final arbitration award and a substantial award of attorneys’ fees and costs to the client.
  • Lead member of litigation team in a trust dispute involving the disposition of trust property; the action resulted in a court judgment in the clients’ favor.
  • Represented real estate broker in dispute involving an oral partnership agreement with another broker; the action resulted in a substantial monetary jury verdict and attorneys’ fee award for the client.
  • Lead member of litigation team in a dispute over the ownership of commercial real property. The action resulted in a favorable settlement confirming the client’s ownership of the property.
