Katie assists clients on a wide variety of legal issues, including lease and contract disputes, business disputes, and employment issues.  She represents clients in all types of litigation matters ranging from real estate litigation, to complex class action litigation, to appeal.  Regardless of the type of litigation, Katie is known as a skilled advocate and strives to provide creative and resourceful solutions for her clients.

Katie regularly practices in state and federal court and routinely represents clients in alternative dispute resolution.  She is well-versed in all phases of litigation, and she can effectively and efficiently handle all aspects of pretrial litigation as well as appellate proceedings.  Whatever the legal problem may be, Katie uses her strong analytical skills and creativity to promote and/or defend her clients’ interests, whether in litigation or on appeal.

Experience

Litigation Experience

  • Assist in all aspects of defending employer in complex litigation in federal court regarding alleged wage and hour violations under both California and federal law.
  • Assist in defending banking institution against consumers in class action litigation.
  • Assisted in representing corporate clients in disputes between shareholders.
  • Representing client in securities fraud litigation.
  • Assist in defending corporate client in breach of contract contract and copyright infringement action.
  • Assist in defending property developer against a public entity in a breach of contract action.
  • Represented client in litigation involving breach of oral contract and fraud.  After representing client in mediation, the action settled favorably for client.
  • Represented almond grower in litigation against almond processor and successfully obtaining a default judgment.
  • Assisted in pre-arbitration and post-arbitration matters in an action brought by former partners against accounting firm client regarding a dispute over the buy-out provision in the partnership agreement and covenants not to compete.
  • Assisted in successfully  defending oil company in complex environmental litigation in federal court involving groundwater contamination.  The action was dismissed on motion for summary judgment.
  • Represented landlord of commercial property in an action brought by the tenant for breach of lease, fraud, and negligent misrepresentation.  Shortly after successfully opposing two motions for summary judgment and/or summary adjudication, the action settled on highly favorable terms for the client.
  • Assisted in representing residential developer in complex litigation action brought by the state for claims relating to trespass and unfair competition.  The action settled on favorable terms for the client.

Appellate Experience

  • Drafted writ of mandate to the California Court of Appeal, Third Appellate District, where the Court issued a Palma notice staying the action and requesting the trial court to either vacate the subject order or the Court will issue a peremptory writ of mandate to vacate the order.  The trial court subsequently vacated the subject order after receiving the Palma notice.
  • Assisted in drafting amicus curiae brief that was submitted in Medina v. Hochberg before the Supreme Judicial Court of Massachusetts, County of Suffolk, in support of the defendant.  The Court ultimately ruled in favor of the defendant and acknowledged the amicus brief in its opinion.
  • Drafted opening and reply briefs on appeal.
  • Successfully opposed motion for sanctions on appeal.
  • Research and analyze various issues on appeal including award of attorneys' fees, and assist in advising clients regarding the merits of appeal.
