Katharine Buddingh brings the analytical and critical-thinking skills that she honed as a federal law clerk to bear on legal issues confronting clients. 

As a member of Downey Brand’s Food and Agriculture Practice, Katharine represents food producers, shippers, processors, and retail grocers across the state.  While her practice focuses on general and commercial litigation, she has also advised clients with respect to regulatory compliance, including compliance with federal and state food labeling laws.

Experience

  • Review and analyze food product label to ensure compliance with federal and state law.  Advise client whether it can make certain product claims. 
  • Assist client in obtaining a PACA license from the USDA.
  • Draft oppositions to demurrers and motions to strike for Fortune 500 Company in construction litigation.
  • Draft motions in limine and oppositions to motions in limine in products liability action involving a fertilizer company.
  • Draft portions of appellate brief in trust and wills litigation involving multi-million dollar estate.
  • Conduct legal research and draft comprehensive legal memoranda regarding the enforceability of stock redemption agreement.
  • Advise client regarding conflict of interest restrictions placed on former California state employee by the Political Reform Act and Fair Political Practices Commission.
  • Conduct legal research and draft comprehensive legal memoranda regarding the enforceability of a forum selection clause in a contract dispute involving multi-national corporations.  Advise the client regarding proper venue to bring suit.
  • Analyze the compliance of client’s competitor with federal and state organic labeling laws and the effect of newly-enacted legislation on competitor’s product.  
  • Advise client regarding the enforceability of severance agreement.
  • Conduct legal research and draft comprehensive legal memoranda regarding various issues arising under CERCLA and the Clean Water Act.
