Experience

Proposition 65

  • Researched and analyzed possible defenses to a Proposition 65 discharge action brought against a water district.
  • Monitored developments at the Office of Environmental Health Hazard Assessment and co-authored an update on recent Proposition 65 cases and regulatory changes.

Land Use

  • Evaluated and analyzed actions for common law causes of action, possible defenses, and potential monetary damages in order to advise a large public utility of their exposure to wildfire liability.
  • Created a land use guide for use within a local public utility to aid them in the selling and disposing of land under California’s Land Surplus Act.
  • Investigated the need for special use permits required under the Federal Land Policy and Management Act, and possible exemptions applicable to the client under the Federal Power Act.
  • Researched the scope and application of public prescriptive easements and evaluated whether a public agency could employ those principles in novel situations.
  • Assisted CEQA attorneys in drafting and revising a community guide to CEQA for a Sacramento non-profit organization.
  • Researched  the viability of bringing nuisance and trespass claims against co-defendants in a CERCLA action in order to mitigate costs to the client.

Water Quality

  • Researched and drafted several sections of a brief submitted in the Ninth Circuit Court of Appeals arguing certain activities by US. EPA constituted underground regulations.
  • Drafted stipulations, motions, and settlement agreements for clients in water quality enforcement litigation.
  • Researched and drafted memorandum on administrative mandamus proceedings, declaratory relief, and exceptions to the California Public Records Act.
