Jake Weaver’s practice encompasses all aspects of general and complex civil litigation, with an emphasis on construction and real estate law.

Through his strong analytical skills, Jake assists clients in navigating the ever-changing laws and regulations facing business owners in California. By utilizing an informed and practical approach, Jake is able to develop both legal and non-legal solutions to secure successful and cost-effective results for clients.

Experience

  • Represent general contractor in bid dispute on a public construction project in excess of $400 million. 
  • Represent general contractor in prosecuting a differing site condition claim. 
  • Obtain temporary restraining order for general contractor precluding the award of a public construction project to a competitor.
  • Represent public agency in bid dispute and assist in determining responsiveness of bids.
  • Extensive experience with competitive bidding laws under the Public Contract Code.
  • Experience with construction payment remedies, including mechanic’s liens, stop payment notice claims, and payment bond claims.
  • Experience with contractor disruption claims, including lost efficiency and acceleration.
  • Represent flood control agency in the acquisition of property by means of eminent domain for a levee improvement project. 
  • Represent commercial tenant in an unlawful detainer action.
  • Represent tenant in landlord-tenant dispute over a long-term commercial lease. 
  • Represent creditors in prosecuting claims for fraudulent transfer.
  • Oversee forensic document collection and issues relating to the discovery and production of metadata.
  • Successfully defend winemakers in a case involving allegations of wine fraud.  Obtained a complete dismissal with prejudice on a motion to dismiss for lack of subject matter jurisdiction.
  • Represented pro bono client in appeal to the Ninth Cirucuit Court of Appeals.
