Since coming to Downey Brand in 2004 from one of California’s largest firms, Andrew Collier has developed a general civil litigation practice focused on complex business disputes.

For more than 15 years, Andrew has successfully and economically litigated disputes in diverse areas involving creditors’ rights, contracts, corporations and shareholders, partnerships, real property, intellectual property, and environmental conditions. Andrew represents individuals and companies, both as plaintiffs and defendants, from multi-generational family owned regional businesses to Fortune 500 corporations, in state and federal court, and before administrative agencies.

Andrew applies his skills, creativity and practical judgment to each case, whatever the subject matter, with equal vigor and value. He forges strong relationships and close connections with his clients and navigates them through the litigation and dispute resolution process in a highly personalized and deeply committed manner—always mindful of their unique needs and goals. Whether it is seemingly as simple as a persuasive telephone call or as arduous as three years of high stakes litigation culminating in a two month jury trial—Andrew is singularly focused on obtaining the most favorable result and effectively solving his clients’ problems.

Andrew has particular expertise in representing financial institutions—often in matters involving agriculture—in the enforcement of commercial loan agreements, guaranties, personal property security interests, and deeds of trust. Andrew has obtained numerous pre-judgment remedies—writs of possession, writs of attachment, and receiverships—on behalf of his creditor clients, and collected substantial amounts in enforcing judgments.


Representative Agricultural/Creditors' Rights Litigation

  • Represented national banking association in obtaining numerous pre-judgment remedies including writs of attachment, writs of possession, and the appointment of receivers.
  • Represented agricultural lending institution in enforcing rights against commercial dairy under loan agreements and deeds of trust, in receivership.
  • Represented agricultural lending institution and resolved alter ego claims against borrower’s family-related commercial rice growing businesses, with favorable settlement following in bankruptcy court.
  • Represented agricultural lending institution and resolved guaranty claim relative to commercial dairy business partnership obligation through state court and bankruptcy litigation.

Representative Receivership Litigation

  • Represented secured creditor and obtained ex parte appointment of receiver for personal and real property collateral.
  • Represented receiver over wine grape vineyard.
  • Represented secured creditor and negotiated resolution to dispute regarding priority of liens with receiver.

Representative Real Property Litigation

  • Represented multi-generational real estate and agricultural company against South Lake Tahoe casino tenant and obtained favorable settlement (one of largest in Nevada history) after acting as second chair on 8-week jury trial.
  • Represented commercial rice grower in purchase agreement dispute with developers and obtained favorable award following 3-day arbitration.
  • Represented local real estate developer in defense of fraudulent transfer action in state and bankruptcy court which was resolved favorably.
  • Represented co-tenant in commercial alfalfa farming operation and obtained favorable settlement in partition action.
  • Assisted in representation of adjacent landowner easement and subdivision dispute that resolved favorably.

Representative Environmental Litigation

  • Assisted in defense of party remediating landfill and obtained favorable settlement on RCRA, CERCLA, and state law claims after successful summary adjudication motion.
  • Assisted in defense of developer against Clean Water Act case brought by citizens’ group and obtained a favorable settlement on the eve of trial.
  • Assisted in defense of California municipality against Clean Water Act case brought by citizens’ group and obtained favorable settlement on the eve of trial.

Intellectual Property Litigation

  • Assisted in defense of regional agricultural product processing company against patent infringement claims and obtained summary judgment in federal court.
  • Represented plaintiff in unregistered trademark claim dispute.
  • General counsel to local technology company.
